DMCA Notice and Takedown Policy

The Fashion Week Blueprint respects the intellectual property rights of others and expects the people who use our platform to do the same. This policy explains how we respond to claims of copyright infringement under the United States Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

If you believe that material available on or through our platform infringes a copyright you own or are authorized to act for, you may send a written notice of claimed infringement to our Designated Agent (the "DMCA Notice").

To be effective under 17 U.S.C. § 512(c)(3), your DMCA Notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to let us locate the material (for example, the URL or page where it appears).
  4. Information reasonably sufficient to let us contact you, such as your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Caution. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees. If you are not sure whether material infringes your copyright, you should consult an attorney before sending a notice.

Notices sent to any other address or contact (general support, sales, etc.) may not be processed under the DMCA timeline.

Our Response to a Valid Notice

When we receive a DMCA Notice that satisfies the requirements above, we will:

  1. Remove or disable access to the material identified in the notice.
  2. Take reasonable steps to notify the user who posted the material that it has been removed or disabled.
  3. Forward a copy of the notice, including the contact information you provided, to that user, so they may submit a counter-notification if they choose.

We may also document the notice as part of our repeat-infringer records described below.

Counter-Notification

If you are a user whose material was removed or disabled and you believe the removal was a mistake or misidentification, you may send us a written counter-notification. To be effective under 17 U.S.C. § 512(g)(3), your counter-notification must include all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who submitted the original notice or that person's agent.

Send your counter-notification to the Designated Agent above.

When we receive a valid counter-notification, we will forward it to the person who submitted the original DMCA Notice. We may restore the removed material in 10 to 14 business days after receiving the counter-notification, unless our Designated Agent first receives notice from the original complainant that they have filed a court action seeking to restrain the allegedly infringing activity.

Caution. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be liable for damages.

Repeat Infringers

We will, in appropriate circumstances and at our discretion, disable and/or terminate the accounts of users who are determined to be repeat infringers. A repeat infringer is a user who has been the subject of more than one valid DMCA Notice, or who has otherwise repeatedly infringed the intellectual property rights of others.

Modifications to This Policy

We may update this Copyright & DMCA Policy from time to time. Material changes take effect when we post the updated version, identified by the version number and effective date above.
